Welcome to PlotSpot (the 'Service', 'we', 'us' or 'our'), operated at plotspot.com.au. By accessing or using the Service you agree to be bound by these Terms & Conditions when you register an account and login. If you do not agree, please do not use our Services.

1. Nature of the Service

PlotSpot provides property market research, analytics, visualisations and related tools that draw on publicly available New South Wales open government datasets, such as property sales, property cadastra and statistical data and GIS informational data. The Service is intended for informational and research purposes only and is primarily focussed as property research and analysis.

Important: PlotSpot does not provide financial, investment, legal, valuation or planning advice. Nothing on the Service constitutes a recommendation to buy, sell or hold any property nor do we have relationships with any organisation that influences the analytical processes. Always obtain independent professional advice and verify information against primary sources before making sales, purchase and/or financial decisions.

2. Government Data & Creative Commons Licensing

The majority of the underlying data used by PlotSpot originates from New South Wales Government sources, including (but not limited to) the Valuer General NSW, Spatial Services (Department of Customer Service), NSW Planning Portal and related NSW State Government open-data portals, along with Australian Bureau of Statistics (ABS) publicly available data.

Creative Commons Attribution

Where the source data is licensed under a Creative Commons licence (commonly CC BY 3.0 Australia, CC BY 4.0, or in some cases CC BY-NC-ND 4.0 for bulk Property Sales Information), PlotSpot complies with the applicable licence terms. This includes:

  • Proper attribution to the relevant NSW Government agency;
  • Indication if the data has been modified or normalised by PlotSpot;
  • No suggestion of endorsement by the NSW Government or any agency.
  • No commercial relationships that would influence analytical analisis and results.

Typical attribution form (adapted as required by the specific dataset):

Contains data from New South Wales Government public information datasets (Valuer General NSW / Spatial Services). Licensed under Creative Commons Attribution [version]. Data may be normalised and aggregated by PlotSpot for analytical purposes.

Users must not scrape, bulk-download or redistribute the raw government datasets in a manner that breaches the original Creative Commons (or other) licence terms. Commercial use of certain bulk Property Sales Information may require a separate licence from the Valuer General.

3. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable Australian law;
  • Attempt to reverse-engineer, scrape at scale, or interfere with the operation or security of the Service;
  • Misrepresent the origin or accuracy of data obtained through PlotSpot;
  • Use automated means to access the Service in a way that imposes an unreasonable load;
  • Reproduce, republish or commercially exploit substantial portions of the Service’s proprietary analyses, normalised datasets or visualisations without our prior written consent (except where the underlying data is openly licensed).

4. Intellectual Property

The PlotSpot name, logo, website design, software, algorithms, normalised datasets, metrics, charts and original content are owned by or licensed to us. Government source data remains subject to its original Creative Commons (or other) licence. You may view and use the Service for personal or internal business research, but you may not claim ownership of the underlying government data or our proprietary processing.

5. Disclaimer of Warranties

The Service and all data are provided “as is” and “as available”. While we apply extensive cleaning, normalisation and validation processes, no property dataset is perfect. We do not warrant that the data is complete, accurate, current or error-free. Government source data itself may contain errors, omissions or delays.

To the maximum extent permitted by law (including the Australian Consumer Law), we exclude all warranties, whether express or implied.

6. Limitation of Liability

To the maximum extent permitted by Australian law, PlotSpot and its operators shall not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits, data, opportunity or goodwill arising from your use of (or inability to use) the Service, even if advised of the possibility of such damages.

Our total aggregate liability for any claim arising out of or relating to the Service is limited to the amount (if any) you paid us in the 12 months preceding the claim, or AUD $100, whichever is greater.

7. Changes to the Service or these Terms

We may update the Service or these Terms at any time. Continued use after changes constitutes acceptance. The “Last updated” date at the top of this page will be revised accordingly.

8. Governing Law

These Terms are governed by the laws of New South Wales, Australia. Any disputes shall be subject to the exclusive jurisdiction of the courts of New South Wales.
